OK, fellas, I don't profess to understand Canadian law. You clearly don't understand American law up in Canada. I read a column on the NHL lawsuit where the columnist at the G and M made the same silly assumption, that Moyes couldn't by law waive his right to take the hockey team into bankruptcy. Note that he didn't declare personal bankruptcy nor bankruptcy of Swift. He just transferred liabilities onto the Coyotes books and then declared bankruptcy. This lawsuit is more likely to air out Moyes dirty laundry than the league's mess. To fight a breach of contract claim here, one must show that either 1. The contract was not breached, 2. The breach was with the express permission of the other party, 3. The contract or certain provisions were not legal, or 4. The contract is unenforceble. Moyes can counter sue on anything that he wants. Should it be that the league didn't give Balsillie a fair hearing, the league need show no more than it did in Baum's courtroom, an interview, discussion and the vote, showing that they followed league proceedures.

I just got back from a vacation in Cuba some of the people (90% Canadian) were there for the Gold medal game. The resort put a projection TV in the disco and had on the Olympics for the Canadians there. They had CTV in English and CBC French on the dish. The Canadians said the Cubans were fascinated by the hockey game and I wouldn't be surprised if they set up one of the basketball courts for road hockey some day. Even the Russians there were cheering for Canada. Great spot with Canadian flags all over the resort. I thought I'd check in and see what's new, some of the same old, same old. Bettman still can't figure out how to sell a hockey team in the desert where there's no water let alone ice.
